1. Intellectual Property (Copyrights and Trademarks)
All content featured on zwallacephoto.com, including but not limited to photographs, text, logos, graphics, and the overall design of the site (the "Content"), is the property of Charles Z. Wallace, operating as zwallace photo, and is protected by United States and international copyright, trademark, and other intellectual property laws. Unauthorized use of the Content may violate these laws and could result in criminal or civil penalties. Such unauthorized use includes, but is not limited to, copying, reproducing, republishing, modifying, uploading, transmitting, or distributing any of the Content without the prior written consent of zwallace photo. The "zwallace photo" logo and all custom graphics and icons are trademarks of zwallace photo.
2. Products, Pricing, and Errors
zwallace photo attempts to ensure that all product descriptions, specifications, and pricing are accurate and current. However, we do not warrant that such information is error-free. In the event a product is listed at an incorrect price or with incorrect information due to a typographical, photographic, or technical error, zwallace photo reserves the right to refuse or cancel any orders placed for that product, at our sole discretion, whether or not the order has been confirmed.
3. Order Acceptance
Your receipt of an order confirmation (automated or otherwise) does not signify our acceptance of your order. zwallace photo reserves the right to accept or decline any order for any reason at our sole discretion, even after an order has been submitted and confirmed. We reserve the right to require additional verification information before accepting or processing any order.
4. Return and Replacement Policy
Due to the custom nature of our products, all sales are final. Products are non-refundable.
zwallace photo will replace physical products that are damaged during shipping or if you receive an incorrect item. To be eligible for a replacement, you must contact us within 10 days of the product's delivery date and return the original product, following the conditions below:
The product must be returned in its original, complete condition and packaging.
zwallace photo will not accept items that have been intentionally damaged.
Return shipping must be prepaid by the customer.
Original shipping and handling fees are non-refundable.
Please allow 2-3 weeks for processing and shipment of replacement orders.
Claims for missing packages must be reported within 10 days of the recorded shipment date.
5. Unauthorized Returns
Shipments that are refused without prior authorization from zwallace photo, or that are returned to us as undeliverable due to an invalid or incomplete address provided by the customer, are subject to a restocking fee of 15% of the product price, plus any applicable shipping and handling fees.
6. Disclaimer and Limitation of Liability
zwallace photo makes no representations or warranties, express or implied, of any kind with respect to the products sold on this site. zwallace photo expressly disclaims all warranties, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
You agree that the sole and exclusive maximum liability to zwallace photo arising from any product sold on this website shall be the price of the product ordered. In no event shall zwallace photo, its officers, employees, or other representatives be liable for any special, indirect, incidental, consequential, or punitive damages related to products sold or arising from the operation, content, or use of this website.
7. Jurisdiction and Governing Law
zwallace photo is a sole proprietorship with its principal place of business in Claremont, New Hampshire. You agree that any legal action brought against zwallace photo shall be governed by the laws of the State of New Hampshire, without regard to its conflict of law principles. You further agree that any and all disputes arising from your use of this site or orders placed through it will be adjudicated in the federal or state courts located in Sullivan County, New Hampshire.
8. Agreement and Modifications
Your use of the zwallacephoto.com website and/or your placement of an order constitutes your acknowledgment that you have read, understand, and expressly agree to be bound by these Terms and Conditions. You hereby authorize zwallace photo to process the payment for the total amount of your order using your chosen payment method. zwallace photo reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time. It is your responsibility to check these Terms and Conditions periodically for changes. Your continued use of the site following the posting of changes will mean that you accept and agree to the changes.
